Please read this Refund & Cancellation Policy Agreement carefully as it contains important information about your legal rights & remedies.

  1. OVERVIEW 
      This Refund & Cancellation Policy as an Agreement is entered into by and  between M/S Teknix (herein referred to as Axisdelta.com – as the website AXISDELTA.COM is a fully owned Brand Name of M/S Teknix with all products and services sold through the website AXISDELTA.COM is the property of the parent registered company M/S Teknix ) and you and is made effective as of the date of your use of this website (“Site”) or the date of electronic acceptance. During electronic purchase of the services from this website AXISDELTA.COM and on successful transaction this Agreement automatically becomes valid for all users collectively from the moment they become valid customers of Products or Services purchased from AXISDELTA.COM.  This Agreement sets forth the Generalized Refund & Cancelation Terms and Conditions of your use of the Site and the products and services purchased or accessed through this Site (individually and collectively, the “Services”). Services Agreements and additional policies apply to certain Services and are in addition to (not in lieu of) this Agreement. 

  2. MODIFICATION OF AGREEMENT, SITE OR SERVICES 
    AXISDELTA.COM may, in its sole and absolute discretion, change or modify this Agreement, and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to this Site. Your use of this Site or the Services after such changes or modifications have been made shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement as last revised, do not use (or continue to use) this Site or the Services. In addition, AXISDELTA.COM  may occasionally notify you of changes or modifications to this Agreement by email. It is therefore very important that you keep your shopper account (“Account”) information current. AXISDELTA.COM  assumes no liability or responsibility for your failure to receive an email notification if such failure results from an inaccurate email address. In addition, AXISDELTA.COM  may terminate Your use of Services for any violation or breach of any of the terms of this Agreement by You. AXISDELTA.COM  RESERVES THE RIGHT TO MODIFY, CHANGE, OR DISCONTINUE ANY ASPECT OF THIS SITE OR THE SERVICES, INCLUDING WITHOUT LIMITATION PRICES AND FEES FOR THE SAME, AT ANY TIME. 

  3. ELIGIBILITY; AUTHORITY 

    This Site and the Services are available only to individuals or entities (“Users”) who can form legally binding contracts under applicable law. By using this Site or the Services, you represent and warrant that you are (i) at least eighteen (18) years of age, (ii) otherwise recognized as being able to form legally binding contracts under applicable law, or (iii) are not a person barred from purchasing or receiving the Services found under the laws of India or other applicable jurisdiction. 

     If you are entering into this Agreement on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms and conditions contained in this Agreement, in which case the terms “you”, “your”, “User” or “customer” shall refer to such corporate entity. If, after your electronic acceptance of this Agreement, AXISDELTA.COM finds that you do not have the legal authority to bind such a corporate entity, you will be personally responsible for the obligations contained in this Agreement, including, but not limited to, the payment obligations. AXISDELTA.COM shall not be liable for any loss or damage resulting from AXISDELTA.COM’s reliance on any instruction, notice, document or communication reasonably believed by AXISDELTA.COM to be genuine and originating from an authorized representative of your corporate entity. If there is reasonable doubt about the authenticity of any such instruction, notice, document or communication, AXISDELTA.COM reserves the right (but undertakes no duty) to require additional authentication from you. You further agree to be bound by the terms of this Agreement for transactions entered into by you, anyone acting as your agent and anyone who uses your account or the Services, whether or not authorized by you. 

  4. THIRD PARTY SERVICES, DATA & CONTENT 
    Some of the Products or Services (Example – Marketix Business Intelligence Dashboard, a flagship product developed by AXISDELTA.COM and Sold as SaaS Product on the website AXISDELTA.COM) allows you to gather data from multiple third-party data sources and services, including various third-party websites (jointly “Third-Party Services”). The Third-Party Services from which the data can be gathered are selected by AXISDELTA.COM at its sole discretion and AXISDELTA.COM may, during the Term, change the Third-Party Services that are compatible with the Product or Service. In addition, AXISDELTA.COM may discontinue the compatible Third-Party Services if the applicable service providers of the Third-Party Services discontinue the relevant services or discontinue making such services available to AXISDELTA.COM. If you create Custom Connectors to access third-party services of your choice from the available list of Third Party Data Platforms, you shall be solely liable for accessing such Services. AXISDELTA.COM shall have a right to discontinue your use of Services, if you breach the terms of this Agreement. 

    Furthermore, the Service may contain links to web pages and content of third parties as a service to those interested in this information. We do not monitor, endorse, or adopt, or have any control over any third-party web pages or content. We undertake no responsibility to update or review any such web pages or third-party content and can make no guarantee as to its accuracy or completeness, and data is provided as is by AXISDELTA.COM as a service. 

  5. OVERVIEW OF REFUND POLICY  

    Products purchased from AXISDELTA.COM  may be refunded only if canceled within the refund period specified in the product pricing details including specialized time bound offer based pricing or discount codes and terms applicable thereof. Some products have different policies or requirements for a refund associated with them, including some products that are not eligible for a refund under any circumstance. Users or Customers are strongly advised to undergo details of purchase plan and pricing details before making a formal purchase from AXISDELTA.COM..  

    “Date of the transaction”, for the purpose of this Refund Policy, means the date of purchase of any product or service, which includes the date any renewal is processed by AXISDELTA.COM in accordance with the terms and conditions of the applicable product or service agreement. 

    “Refund Period”, you may cancel a product at any time, but a refund will only be issued if you request a refund with AXISDELTA.COM’s customer service within the refund time frame specified for the applicable product, if available at all. 

     No Refund After Account Closure. If eligible for a refund, it is necessary for you to request a refund prior to account closure. You may elect to close your account with us at any time, but upon account closure you will no longer be eligible for a refund as otherwise permitted under this Refund Policy. 

  6. INDEMNIFICATION AND PRO RATA REFUND POLICY 

    AXISDELTA.COM will defend, indemnify and hold harmless Customer from and against any costs, damages, expenses, and liabilities (including, but not limited to, reasonable attorneys’ fees) arising out of or in relation to third-party claims or actions arising out of or relating to infringement of a third party’s intellectual property rights due to Customer’s use of the Service, except to the extent such claims or actions arise out of or are related to  

     (i) any modification or combination of the Service by Customer with any service not provided by AXISDELTA.COM;  

     (ii) any third-party programs, information, or data (including any Third-Party Services);  

     (iii) any access or use of the Services by Customer in violation of these Terms, including the restrictions of any data, information, or content provided by Customer. 

     AXISDELTA.COM’s indemnification obligation in this Section only applies under the condition that Customer has notified AXISDELTA.COM in writing of a claim or action within a reasonable time. 

     In case such third party claim is made or is likely to be made, AXISDELTA.COM is responsible, at its own cost, for obtaining any necessary rights for Customer to continue to use the Service under the terms of the Agreement or replace or modify the infringing part of the Service to be non-infringing without decreasing functionality. If AXISDELTA.COM is unable to replace or modify the infringing part, then AXISDELTA.COM may terminate this Agreement upon written notice to Customer, in which case Customer shall be entitled, as its sole remedy, to a pro-rata refund in the amount of the unused portion of any prepaid fees for the terminated Service calculated as of the effective date of termination. AXISDELTA.COM liability, and your sole remedy, for infringement of intellectual property rights in the Service shall be limited to this Section only and exclusively. 

  7. FEES AND ONLINE PAYMENT POLICY

    Access to selected features of the Service may be provided to you free of charge. We will charge fees for certain features, either on a one-time or a subscription basis (“Paid Services”). AXISDELTA.COM reserves the right to implement fees or change the fees for certain services at any time by providing you notice on the Service or otherwise. When you purchase any Paid Services, you authorize AXISDELTA.COM or its third party payment processors to charge the credit card identified by you (which you represent and warrant that you are authorized to use) all applicable fees for your purchase, including all applicable taxes, and you agree that our payment provider can store your credit card information. If AXISDELTA.COM does not receive payment from your credit card provider, you agree to pay all amounts due upon demand and AXISDELTA.COM may suspend your access to the Services until full payment is received or terminate the Terms of Service. All sales are final and AXISDELTA.COM will not issue refunds, including for prepaid monthly fees. If you choose an automatic recurring payment and later decide to end your subscription, canceling the payment is your responsibility. AXISDELTA.COM does not refund automatic payments not canceled in time.
